Song Xiaoshi

Terms of Service

Effective: 29 October 2026 · Version 1.0

1. Who you are contracting with

These Terms govern your purchase of digital source-code products from Song Xiaoshi ("we", "us", "the Seller"). The Seller is an individual operating under the laws of the People's Republic of China. Our contact address is kyungbin@163.com.

Payment processing and the sale of digital goods to you are completed by a third-party payment platform acting as Merchant of Record ("the Processor"). The Processor is the legal seller on your transaction, issues your invoice, and collects and remits any applicable sales tax, VAT or GST. Your order confirmation names the Processor. These Terms govern the license grant, delivery, refunds and support for the product itself.

2. Products and delivery

Products are delivered as downloadable archives (source code and documentation). Delivery is electronic and automatic: a download link is provided on the order receipt page and in the confirmation email. Delivery is deemed complete once the download link has been made available to you.

Products are sold as-is, in the form and version shown on the product page at the time of purchase. We may update products after purchase; where an update materially changes the product we will notify purchasers by email, but updates are not guaranteed and are not a purchase obligation.

3. Price, payment and currency

Prices are shown in US Dollars (USD) and exclude any tax that the Processor calculates and collects at checkout based on your billing address. The amount shown at checkout, including tax, is the amount you pay. Payment is due at the time of purchase.

Currency conversion, if your bank charges a conversion fee, is borne by you and is outside our control.

4. License grant

On payment, we grant you a non-exclusive, non-transferable, perpetual license to use the purchased source code. The license permits:

The license does not permit:

Ownership of the source code remains with the Seller. The license does not transfer any intellectual property rights beyond the uses listed above.

5. Your responsibilities

You agree that you will:

6. Refunds

These products are delivered electronically and cannot be returned, so refunds are discretionary rather than automatic. We will refund a purchase where:

Refund requests within 14 days of purchase are honoured. Requests after 14 days are considered individually; where a product has been downloaded and used in production for a substantial period, a refund may be declined. We aim to respond to refund requests within 3 business days.

Where a refund is granted, it is issued to the original payment method by the Processor, and may take 5–10 business days to appear depending on your bank. Where a product is refunded, the license granted under section 4 ends.

7. Your termination rights and effect of termination

You may stop using the products and delete all copies at any time. This right is unconditional and does not require our consent.

Where you have used the products commercially and then delete them, you must also remove the corresponding functionality from any product or service you distribute that depends on the licensed code, except where you are separately licensed or where the use is permitted under section 4.

8. Termination of this agreement for breach

These Terms are terminated automatically, without notice, if you materially breach them — including by redistributing the source code, publishing it publicly, or using the products in violation of the Acceptable Use Policy.

On termination for breach:

Termination of this agreement does not affect any rights or obligations that accrued before termination. Sections 4 (as limited by this section), 9, 10 and 12 survive termination.

9. Warranties and disclaimers

We warrant that the source code is original work created by us, that it does not knowingly infringe third-party intellectual property rights, and that it will perform substantially as described on the product page.

Except as stated above, the products are provided "as is" without further warranty of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. The products are development tools; you are responsible for testing them in your own environment before relying on them in production.

10. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or relating to these Terms or a purchase is limited to the amount you actually paid for the product giving rise to the claim. We are not liable for indirect, incidental, special, consequential or exemplary damages, or for lost profits or revenue, even where we were advised such damages were possible.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud or fraudulent misrepresentation.

11. Indemnity

You agree to indemnify the Seller against claims, damages, losses and reasonable costs arising from your misuse of the products, your breach of these Terms or the Acceptable Use Policy, or your distribution of products built in breach of section 4.

12. Governing law and disputes

These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law rules. Any dispute that cannot be settled by good-faith discussion between us within 30 days of written notice of the dispute will be submitted to the competent courts of the Seller's place of residence. Nothing in this section limits any mandatory consumer rights you may have under the law of your country of residence.

13. Changes to these Terms

We may update these Terms. The version that applies to your purchase is the version in effect on the date of purchase, shown at the top of this page. Material changes will be announced on this page with a new effective date and version number.
